b. Other. Immediate action is initiated prior to separation to ensure prompt and
appropriate disposition. If the next of kin of a psychotic patient will not accept the patient or
provide necessary care, the medical treatment facility commander communicates with the
appropriate civil authorities in the patient's State of residence to obtain permission to
transfer the patient to State custody. If permission is not granted, the procedure is
repeated with civil authorities in the State from which the patient entered the service if that
State is different than the State of residence. For other than a psychotic patient, the
patient who is capable of making his own decision is provided assistance in making
arrangements for hospitalization. If such action cannot be accomplished because of the
patient's condition, the next of kin is requested to make arrangements for and accept the
patient.
Section VI. REVIEW AGENCIES
5-34. U.S. ARMY PHYSICAL DISABIL ITY AGENCY (USAPDA)
a. Disability Review Council.
(1) All cases are routinely forwarded for review to the USAPDA which utilizes
the Disability Review Council.
(2) The purpose of the review is to ensure that:
(a) The member received a full and fair hearing.
(b) Proceedings of the medical board and the PEB were in accordance
with governing regulations.
(c) Findings were just, equitable, consistent with the facts, and in
conformance with laws and regulations.
(d) Due consideration was accorded facts and requests in any rebuttal to
the PEB findings and recommendations.
(e) Records are accurate and complete.
b. Possible Actions.
(1) After reviewing the proceedings, pertinent medical records and other
records and evidence attached, the Council may either concur with the findings and
recommendations of the Physical Evaluation Board, recommend changes or modifi-
cations, or return the case to the appropriate activity for further action.
